Who you are contracting with

Your contract is with ShopyBuilder, a proprietorship of Abhishek Kumbhare, at the details below.

Eligibility and your account

• You must be at least 18 years old and legally able to enter into a contract.
• You must give accurate account information and keep it up to date.
• One person or business gets one account. Do not share your login or resell access to your account.
• You are responsible for everything that happens under your account and for keeping your password safe. Tell us immediately if you think someone else has access to it.

You can close your account at any time by writing to us. We may suspend or close an account that breaks these terms, as described in the suspension section.

What the service does

ShopyBuilder takes product information that you provide, and uses AI models to propose a page structure, write marketing copy and generate images. It then renders those as styled sections and gives you self contained HTML, CSS and JavaScript that you can paste into your own website or store.

We provide the tool. We do not provide marketing advice, legal review of your claims, or any guarantee about the commercial performance of the pages you build. Nothing in the service is a promise of sales, conversion rate, traffic, search ranking or approval by any platform.

Credits, plans and payments

• Paid plans include a monthly allowance of credits. Credits are consumed when the AI generates content: analysing a product and planning a page, writing the copy, regenerating a section, or producing images. The current credit cost of each action is shown inside the application.
• Previewing sections, editing content, changing theme styling and exporting code do not consume credits.
• Plan credits are for the billing month and do not carry over. Buying a new month replaces whatever is left of the previous month's credits. Separately purchased top up credits are valid for 180 days from your most recent top up and require an active plan to use.
• Plans and credits are charged in Indian Rupees (INR). A price shown in another currency is a guide only; the INR amount you will be charged is shown at checkout before you pay.
• Prices are inclusive of applicable taxes. The operator is not currently registered under GST. If GST registration becomes applicable in future, prices and invoices will reflect it and you will be told before it takes effect.
• Payments are handled by our payment gateway. We do not see or store your card or bank details.
• Each plan is a one-time payment for 30 days. Nothing renews automatically and nothing is charged again without you choosing to buy; to continue after 30 days, you buy a new month.

Refunds and cancellations are covered in full by our Refund and Cancellation Policy, which forms part of these terms. Delivery of what you buy is covered by our Service Delivery Policy.

Ownership of what you create

This is the part most people want to be sure about, so it is stated plainly.

• Your input stays yours. The product information, brand details, text and images you put into ShopyBuilder remain yours. You grant us only the limited permission we need to process them in order to run the service for you, including sending them to our AI provider to produce your output.
• Your output is yours to use. Subject to you having paid for the credits used, you own the generated copy and images and the exported section code for your own commercial use. You can publish them, modify them and keep using them after your subscription ends.
• The tool itself stays ours. The ShopyBuilder application, its section templates, its editor, its underlying code and its name and branding belong to the operator. You are given a licence to use the tool while your account is active. You may not copy, resell, sublicense, reverse engineer or redistribute the tool or its section library as a product of your own, or build a competing builder from it.
• AI output is not exclusive. AI models can produce similar output for different users from similar inputs. We cannot and do not promise that your generated text or images are unique, or that they are eligible for copyright protection in your jurisdiction.

Your responsibility for what you publish

You decide what goes on your store. Before publishing anything generated by ShopyBuilder, you must review it and make sure it is accurate and lawful for the products you sell and the countries you sell into.

• Do not publish claims the AI produced that are not true of your product, especially about health, safety, ingredients, certifications, test results, awards or country of origin.
• Do not present generated reviews, testimonials, ratings or customer counts as if they were real. Placeholder review sections are design templates and must be filled with genuine customer feedback before they go live.
• Comply with consumer protection, advertising and labelling law that applies to you, including the Consumer Protection Act, 2019 and the rules on misleading advertisements and endorsements in India.
• Make sure you have the rights to any images, logos, brand names or reference material you upload.

Acceptable use

You may not use ShopyBuilder to create or promote:

• Anything illegal in India or in the country you are selling into, including restricted drugs, weapons, counterfeit goods and pirated content.
• Content that infringes another person's copyright, trademark, design or other rights, including asking the tool to reproduce a specific brand's creative, packaging or copy.
• Misleading medical, therapeutic, financial or income claims, or content designed to deceive buyers.
• Sexual content involving minors, content that sexualises minors, or any content that exploits or endangers children.
• Hateful, harassing or violent content, or content that targets a person or group.
• Malware, phishing pages, fake login or payment screens, or pages that impersonate a real business or person.

You also may not attempt to break, overload or bypass the service: no automated scraping of the section library, no sharing of API responses, no circumventing credit limits, no probing our infrastructure for vulnerabilities without our written permission.

Reference images and people

Some tools, such as Reference to Image, let you upload an existing advertisement or photo as a reference, together with a photo of your product. Before you scan or generate, you confirm that:

• You own every image you upload, or you have the permission or licence needed to use it this way.
• You have the consent of any identifiable person shown in a reference image, or the image is free for this use.
• You are responsible for how you use, publish and distribute the result.

ShopyBuilder is a tool that generates images on your instructions. We do not check who owns a reference image, and we do not grant you any rights in it. The output may closely follow your reference when you choose Exact, so it is your job to make sure that is lawful where you publish it.

• You may not use the service to copy the face or likeness of a real person without their permission, to imitate a celebrity or public figure, or to create images that pretend to be someone else's advertising.
• When a reference appears to show a child or a well-known person, the tool will not keep that person as they are. It creates a newly cast person instead.
• Images made with Reference to Image are marked as AI-generated: our AI provider adds an invisible watermark, and we write an AI-generated label into the file's metadata. Do not remove or hide these marks to pass the image off as a real photograph.
• We keep a record of each generation (your account, the time, and fingerprints of the images used and produced, not the images themselves) so that we can answer a rights complaint. The Privacy Policy explains how long.

Social Posts

Social Posts turns your saved brand details and the images you attach (a product, your shop or place, or an avatar or person) into ready-to-post designs. Uploading an image or saving brand details in this tool means you accept the points below; you are not asked to confirm them again for each post.

• Your uploads. You own, or have permission to use, every logo, product photo, shop photo and avatar you add. When an image shows a real person, you have that person's permission to use their likeness in your marketing, and a parent's or guardian's permission for anyone under 18.
• Similar designs. Posts are generated by AI from design principles, not copied from a library, but a result can still resemble another brand's post, a template or a popular style. Check every post before you publish it, and do not use the tool to copy someone else's creative.
• Other brands. If you are an authorised retailer, reseller or dealer, you may show the genuine products you sell, including the brand names and logos as they appear on those products, in line with that brand's own guidelines. Do not suggest that you are the brand's official partner, or that it endorses you, unless it has authorised you to say so. Do not add another business's logo or trademark to a post without the right to use it.
• Offers and claims. Prices, discounts, dates, stock and claims in a post come from what you tell the tool. You are responsible for them being true when you publish.
• Platform rules. Follow the rules of the platform you post on, including its advertising policies and any rule on labelling AI-generated content. Platform icons appear only to identify your account handle; the platforms do not sponsor or endorse ShopyBuilder or your posts.
• Festivals and faith. Festival and religious imagery is made to be shown with respect. Do not use it to mock or offend any community or belief.
• Saved brand details. Brand details you choose to save are stored in your account as described in the Privacy Policy, and you can edit or delete them at any time.

Reporting and takedown

If you believe an image made with ShopyBuilder uses your face, your photograph, your artwork or your brand without permission, write to our grievance officer, Abhishek Kumbhare, at [email protected]. Please include the image or a link to it, what you own in it, and how to reach you.

We acknowledge complaints within 24 hours and resolve them within 15 days of receipt. Where a complaint is valid we may remove the content from our service, suspend the account that made it, and share the generation record with you or with the authorities where the law requires it.

Third party services and trademarks

ShopyBuilder is an independent tool. It is not affiliated with, endorsed by, sponsored by or certified by any ecommerce platform, payment provider or other company whose products it works with. All product names, logos and trademarks are the property of their respective owners, and any reference to them is for identification and compatibility purposes only.

The service depends on third party providers for AI generation, storage, email and payments. If one of them has an outage or changes its terms, parts of the service may be unavailable or may change. We are not responsible for the acts, omissions or availability of those providers, and their own terms govern your relationship with them where you deal with them directly.

Availability and changes

We aim to keep the service available, but it is provided without any uptime guarantee. We may need to take it offline for maintenance, updates or emergency fixes. We may add, change or remove features, section templates or AI models over time. Where a change materially reduces what a paid plan offers, we will give you notice and you may cancel and request a refund of the unused portion of that period under the refund policy.

We may change these terms. The current version is always the one on this page with the date at the top. Material changes will be notified by email or inside the application before they take effect, and continuing to use the service afterwards means you accept them.

Suspension and termination

We may suspend or terminate your access if you break these terms, if your use puts the service or other users at risk, if a payment is reversed or charged back, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem.

If we terminate your account for a breach, unused credits are forfeited and no refund is due. If we discontinue the service entirely, we will give you reasonable notice, let you export your work, and refund the unused portion of any period you have already paid for.

You can close your account at any time from My Account in the app. Closing it permanently deletes your projects and gallery images, and any unused credits are forfeited with it. If you want a refund of unused credits under our Refund Policy, request it before you delete your account.

Code you have already exported keeps working after termination. It runs on your own site and does not depend on us.

Disclaimers

The service is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the service will be uninterrupted, error free, secure against every threat, or that AI generated output will be accurate, complete, original, compliant with any particular platform's policies, or fit for any particular purpose.

Nothing in these terms excludes or limits any right you have under Indian consumer law that cannot lawfully be excluded or limited.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, sales, goodwill, data or business opportunity, arising from your use of or inability to use the service.

Our total liability to you for all claims connected with the service in any twelve month period is limited to the total amount you actually paid us for the service in the three months immediately before the event giving rise to the claim.

These limits do not apply to liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Indemnity

You agree to indemnify and hold us harmless from claims, demands, losses, damages and reasonable legal costs brought by a third party and arising from content you published using the service, your breach of these terms, your infringement of someone else's rights, or your breach of any law that applies to your business. We will tell you promptly about any such claim and will not settle it without talking to you first.

Governing law and disputes

These terms are governed by the laws of India. Subject to the step below, the courts at Betul, Madhya Pradesh have exclusive jurisdiction over any dispute arising out of or in connection with them.

Before starting any legal proceeding, please write to us at [email protected] and give us 30 days to try to resolve the matter. Most problems are billing or access issues that can be fixed quickly and without cost to either side.

General

• If any part of these terms is found unenforceable, the rest continues to apply.
• If we do not enforce a right immediately, we do not give it up.
• You may not transfer your account or these terms to someone else without our written consent. We may transfer them to a successor operator of the service, on notice to you.
• These terms, together with the Privacy Policy, the Refund and Cancellation Policy and the Service Delivery Policy, are the entire agreement between us about the service.
